How to check if a used car has outstanding finance

Buying a car that still has money owed on it is one of the most expensive mistakes a private buyer can make. The finance company may have a claim on the car, and the seller may be long gone by the time you find out. In the trade, nobody buys a car without a finance check. Here is how to make sure you do not either.

Why the log book will not tell you

Many buyers assume that if the seller has the V5C log book in their own name, the car is theirs to sell. It is not that simple. The V5C records the registered keeper, the person responsible for the car, not necessarily its legal owner. A car on hire purchase or conditional sale belongs to the finance company until the last payment is made, yet the person paying for it will usually still hold a genuine log book.

The log book checks still matter. GOV.UK's Check a used vehicle you're buying page explains how to spot a stolen V5C, and our V5C log book guide walks through them. They simply do not answer the finance question.

What the free GOV.UK checks cover

GOV.UK sets out free checks every buyer should do before viewing: confirm the details match DVLA's records, read the MOT history and check for safety recalls. None of these searches finance records. For that you need a paid vehicle history check from a private provider that includes an outstanding finance search. Our free vehicle history check guide explains what a car report shows, or you can start a vehicle history checkAd with MotorCheck. (We may earn a commission if you buy a report through MotorCheck, at no extra cost to you.)

How to run a finance check properly

  1. Get the registration and VIN. Ask for the registration before you travel. On the day, check the vehicle identification number on the car matches the log book.
  2. Choose a check that includes finance. Not every report includes it. Read what is covered before you pay.
  3. Run it close to the time you pay. A check from last week cannot show a loan taken out since. Run it on the day, or as near to it as you can.
  4. Make sure the details match. The make, model, colour and VIN in the report should match the car in front of you.

Questions to ask the seller

Ask directly: "Is there any finance outstanding on the car?" Ask before you travel and again on the day. A straight answer costs an honest seller nothing. If they admit there is finance and offer to clear it from your payment, do not hand over money until you have confirmation in writing from the finance company. Our guide to questions to ask a private seller has the rest of the list.

If you find out after you have bought

According to Citizens Advice, you often have a right to keep the car, called "good title", even if it is still on hire purchase or conditional sale. That applies if all of these are true:

  • you did not know the car was on a hire purchase or conditional sale agreement
  • you bought it honestly with no reason to think there was a problem ("in good faith")
  • you are a private buyer, not someone who buys cars to sell or hire on
  • you are the first private buyer from the person who has the agreement

Citizens Advice also states that it is up to the finance company to prove you do not have good title. If you do not have good title, you may be able to claim a refund from the seller. That is a stressful route, and far harder than a check before you pay.

The trade view

A finance check is the cheapest insurance in car buying. Do the free GOV.UK checks first, then the paid history check, and keep the receipt, the advert and the seller's details whatever happens. Next, read our guide to checking a used car's MOT history, or see what is inside Buy It Right.

Frequently asked questions

Does the V5C log book show outstanding finance?

No. The V5C shows the registered keeper, not the legal owner. A car can be on hire purchase and still have a perfectly genuine log book in the seller's name.

Can I keep a car I bought that still had finance on it?

Citizens Advice says you often have a right to keep the car if you did not know about the agreement, bought it in good faith, are a private buyer and are the first private buyer from the person with the agreement. Get advice if this happens to you.

How do I check for outstanding finance?

GOV.UK's free checks do not cover finance. You need a paid vehicle history check that includes a finance search, and you should run it on the day you agree to buy.
